FAKE hp LAPTOP BATTERIES, ADAPTERS BEING SHIPPED THROUGH AMAZON & FLIPKART, SEIZED


HUGE FESTIVE DISCOUNTS OR FAKE PRODUCTS?

Mumbai: Amidst the huge online festive discount season, D B Marg police station has raided two establishments and seized fake batteries, adapters, and counterfeit stickers of HP that were being shipped for sale on leading ecommerce platforms including Amazon and Flipkart. The raid was
conducted after an anti-piracy agency - Enforcers of Intellectual Property Rights (EIPR) researched and informed the local police about the scam. Taking prompt action against the seller, D B Marg Police Station raided Computer Services Venture at 11/13, Patel Mansion in Topiwala Lane, Opposite D B Marg Police Station, Lamington Road and seized the fake products that were branded as HP products. The seller is an authorized dealer of Amazon and Flipkart and has been blatantly selling these fake products to customers through these platforms.

Police have arrested two people from the establishments and FIR is being lodged against the accused at D B Marg Police station.


“With online shopping sites offering stupefying discounts as part of festive sales offers, consumers are spoilt for choice and are coerced into not missing the sale. However also it is during these sales that incidences of incorrect goods being received or products not working properly or in some cases, specifically products like batteries exploding during use are becoming common. An incidence that took place earlier today may offer an explanation to this,” says Gulfaraz Makani, Director, EIPR.

SELLING AT MRP NOT APPLICABLE FOR HOTELS & RESTAURANTS


Hotel Body Issues Clarification To ‘PurportedMinisters Remark 

Mumbai: The Hotel and Restaurant Association of Western India (HRAWI), in a bid to remove any ambiguity over selling water, aerated drinks and similar commodities above the Maximum Retail Price (MRP), has issued a circular to its members clarifying that hotels and restaurants could continue to sell the same above the MRP. However, it also advised not to sell water bottles or such commodities carrying MRP over the counter at all, and if they do, must be sold at MRP.
The HRAWI is a member association in the western region of the Federation of Hotel and Restaurant Associations of India (FHRAI), the apex body of hotels and restaurants in the country. It issued the circular in response to queries posed by members after a section of the media quoting Consumer Affairs Minister Ram Vilas Paswan carried a news item that selling water and aerated drinks above MRP could attract fine and a jail term. Some news items had also wrongly stated that Hotel Association’s cases have been dismissed in High Court and Supreme Court.
“Running the story without appropriate verification has caused confusion and misunderstanding between hoteliers and their patrons. As per the present law, there is no such legal repercussion that can prosecute a hotel or restaurant for the sale of either packaged drinking water or aerated drinks or any such commodity above the MRP while being served in the premises i.e, inside Hotels and Restaurants. So we have advised our members that they can continue selling at suitable rates as the MRP law applies to retailers only,” says Mr Pradeep Shetty, Hon Secy, HRAWI & Chairman - Legal Matters sub-committee, FHRAI & HRAWI.
FHRAI had filed a Writ Petition before the Delhi High Court challenging the notices issued under the then prevailing law namely the Standards of Weights and Measures Act for serving water above MRP.  The Ld. Single Judge of the Delhi High Court by judgment dated 5.3.2007 in W.P. No 6517 of 2003 allowed the writ petition filed by FHRAI holding inter alia that, “charging prices for mineral water in excess of MRP printed on the packaging, during the service of customers in hotels and restaurants does not violate any of the provisions of the SWM Act as this does not constitute a sale or transfer of these commodities by the hotelier or restaurateur to its customers. The customer does not enter a hotel or a restaurant to make a simple purchase of these commodities. It may well be that a client would order nothing beyond a bottle of water or a beverage, but his direct purpose in doing so would clearly travel to enjoying the ambience available therein and incidentally to the ordering of any article for consumption…
“Thereafter, two other Courts ( Kerala and Delhi HC ) have also held non-applicability of MRP to items sold in hotels and restaurants. It is regrettable that wrong information continues to circulate even on matters like these. Nobody comes to a hotel or a restaurant to purchase goods or commodities; they come to our establishments to enjoy service and ambience. As hoteliers, our primary focus is on providing memorable experiences,” concludes Mr. Dilip Datwani, President, HRAWI.

Mumbai: Mr. Dilip Datwani, Chairman & Managing Director, Datwani Hotels Pvt. Ltd. has been elected as the President of the Hotel and Restaurant Association of Western India (HRAWI) for the year 2016-2017 at the 66th Annual General Meeting (AGM) held in Mumbai.

Mr. Dilip Datwani has been an active voice and part of the hotel and restaurant fraternity for over two decades. Known for actively promoting the interests of the industry, he has in the recent past officiated in several capacities including Chairman of the Membership Committee, Chairman of the Classification Committee, and Senior Vice President of HRAWI; besides being an Executive Committee Member of Federation of Hotel and Restaurant Associations of India (FHRAI).

“The HRAWI has made tremendous progress and has crossed several important milestones in the last few years. The immediate past committee leadership has relentlessly strived to voice the concerns of members to the Governments and has ensured expedited resolutions where it was much needed. Of the several things that are being panned out for the future at HRAWI, the first would be to set up a Food Testing Laboratories that will provide hotels and restaurants the benefit of conducting an unbiased audit of foods from their kitchens,” says Mr Dilip Datwani, President, HRAWI.

Dilip Datwani owns and operates Shatranj Napoli, a landmark restaurant at Pali Hill, Bandra. A far-sighted entrepreneur, Mr Datwani incepted this stand-alone specialty restaurant back in 1989 which to date, toasts the who’s who of the corporate and the cine world. Besides this, he also operates a transit hotel – Jayshree at the Mumbai Domestic Airport and has plans to set up a business boutique hotel at Bandra-Kurla Complex.

“Our immediate priority is to implement and promote the independent hotel classification. This was developed by HRAWI in a bid to modernize and standardize the classification procedures of hotels as per international standards. Under the Ease of Doing Business for hospitality, we intend to knock on the doors of the several departments including Tourism Urban Development, Home department, and Excise among others for addressing issues ranging from opening up of 24x7 tourism zones and Single Window Clearance to Scrapping of ‘One day – Club License’ and health permits. Apart from this we will continue working inclusively with the Governments on several other fronts which the association has been pursuing in the interest of hospitality and tourism in India,” concludes Mr. Datwani.
